Surface of VMS4 has scratches on it

Yesterday i received the unit and while i was unpacking i noticed scratches all over the top surface. It is like the unit has been used...
Also the controller is not stable when it stands on a flat surface like a table, i think one of the four rubber "legs" has not been placed correctly during the assembly of the unit.

Anyone with similar issues?
